I had filed complain of ragging in police station. To prevent reputation of the college Dean sent a letter to police stating that I am not mentally fit. all my rights are hence curtailed and same is informed to me by police in written. what to do?

Under RTI one can only seek the information as existing in any material form with public authorities and then may use them further. You may file two RTI applications. One with the police department seeking the said letter received from the Dean, file noting and all other documents connected with your case in their record. Second application may be filed with college authorities seeking a copy of the Dean’s letter written to the police department, the relevant documents on the basis of which the Dean made such conclusions and all other documents connected with your case in college records. You can seek information from college only if it is government or aided college. Remember both these authorities can not refuse information to you as it is your own case. Thereafter information obtained as above can be further used like police department be approached with documents received from college which prove that the letter written by the Dean had no basis.

When there is no response from PIO within 30 days of application, it is a situation of deemed refusal and you should file first appeal.

Some public authorities have prescribed their own applictaion format. To expedite the matter, it is advisable that the request application for information is filed in the relevant application form. You can ask the public authority for the same. In case the public authority where you wish to apply does not have such a format,you can apply in your own format. You application should contain your name, contact details, details of information sought and details of application fee being paid. contact us again for any further clarification.

These are self-governing institutions, governed by their own by-laws etc. If any such registered society has received any government assistance e..g. funds, land, grants for various purposes etc then these organizations become public authorities. If no such assistance has been received these are not public authorities. However, there is scope of getting some information even then. Such organizations have to submit annual returns to the Registrar of Co-operative societies and in case of banking, to RBI. All such information can be accessed under the RTI Act.

The company Reliance Infrastructure Ltd is not a public authority under the Right to Information Act and therefore not obliged to provide any information under this Act.

Property Tax on rented Residential Properties In Bandra Recalamtion Area on the properties leased by MHADA under HIG Scheme in a tabulised form as follows:
1) Building number
2) Nos of Flats (in respective residential building)
3) Nos of Flats (in respective residential building)given on rent during 2008-2009.
4) Nos of Flats (in respective residential building)given on rent during 2009-2010
5) Nos of Flats (in respective residential building)given on leave and licence during 2008-2009.
6) Nos of Flats (in respective residential building)given on leave and licence during 2009-2010.
7) Building numbers / amount claimed from each of these building by Notice - served by BMC for 2008-2009.
8) Actual amount collected as resented Property Tax by BMC from each of rented / leave and licenced flats for each of building in reclamation HIG Scheme building for 2008-2009.
9) Reason - as per BMC Record for reduced collection of Tax amount.

Under the Right to Information Act, application seeking information is to be filed with the Public Authority possessing information desired by you. Sure Yes. The 'right' under the Right to Information Act is to every 'citizen' of India irrespective of his employment, profession or vocation. Therefore a government servant in his capacity as a citizen of India, can request his own employer,to provide the desired information.

i am employed with army school on adhoc basis for one year. i was given a certain class before summer vacations and a new teacher joined three days after me. i was made to do all the work of preparing initial registers and work load was high. after vacations my class has been given to the other teacher who was not made responsible for any class before summer vacations. and i have been given a new class for which i will again have to prepare everything right from beginning.
so the other teacher did not have to do anything and recieved everything readily done by me. if she was to be given that class, she could have been given that earlier before the vacations and should have prepared all the registers. no other changes have been made in the entire school for any other teachers. can i ask for the reasons for this from my school under rti without the fear of loosing my job. do i have to go legally or i can ask for it from the school directly. how do i go about it? army school is a semi govt organisation.

You desire to know the reasons for the change. You can file an application under the RTI Act directly with the school authorities. A simple application addressed to Central Public Information Officer of your school alongwith application fee of Rs. 10/- will serve the purpose. As for fear of losing your job, it is your perception which should count. We are no authority to answer this part of the query.

You may file an RTI application to the PIO in the office of the District Magistrate. Give details of encroachment which are in you knowledge. Ask him which officer is responsible for removal of these encroachments. And, whether these encroachments are in the knowledge of administration. Also, what steps have been taken in last one year or so by administration to remove the encroachments.

You cannot ask for salary under the RTI act. This Act gives you right to seek information including documents. But you should file RTI with Ministry of Education asking for reasons for salary being withheld which might help you.

i had filed an application for information to the PIO/CID as he had prepared a report on religious grounds that christians in Goa are involved in using oud sound and their activities are causing law and order situation which report was furnished to me earlier. However the information sought for withing 48 hrs as a matter of religious liberty as he instructed the D.Sps to keep strict watch on these activities. was rejected How do I go about filing appeal and before which authorithy and the format for filing the same. It is urgent please.

You may prefer first appeal addressed to the First Appellate Authority under the RTI Act in the office of teh D.G. Police (CID). There is no format for preferring first appeal. For your information the PIO is duty bound in his response to your application to give details of the first appellate authority where first appeal has to be filed.

on whqat grounds do i file the appeal as CID/SB is exempt organisations in providing information and same can only be provided under human rights vilations and allegations of corruptions. I have have prefered a first appeal on these grounds but are there any judgements of cic passed on similar lines directing CID /SB to provide information! urgent pleas.

Your query does not clearly convey what you desire to know. An APIO is positioned only to facilitate public, where direct contact with PIO may be difficult by virtue of geographical location or, may be time consuming. An APIO has no critical role to play except that he acts as an agent for PIO for the purpose of receiving applications etc. Normally then in an office where a PIO exists, there should not be any need of APIO. For any clarifications still required, please contact again.

Read the bare Act again and again. Go to web site www.rti.org.in where you will get sufficient knowledge as also on teh website of the Central Information Commission where decisions from various Courts have been compiled. Also read the selected decisions of the CIC on this website. After that if you have difficulties, contact us freely.

If they have appointed a Public Information Officer, then they ought to have appointed a Appellate Authority as well. File an appeal before appellate authority first. You can also file a complaint with the Information Commission against this state but that might take a long time to come up for hearing. Better try filing first appeal.

NO. The Right to Information Act does not bind the Public Authority from replying to your questions. You can only seek information. The scope of what is information is however quite vast.

If you are in a government college or a government aided college, then your college is a public authority under the RTI Act and have to respond to RTI applications. Your matter is simple. File an application under RTI Act asking for reasons recorded for reducing your scholarship.

I am secreatory of youth congress and I have given application to B.S.A. Mahamayanagar on my letterpad. He has written that information through RTI can not given to you because you have aplied on your letterpad. Is it legal or illegal?
