COMPENSATION

Complaints can be lodged and compensation claimed for any loss suffered by the complainant citizen. The loss has to be due to any proceeding under the Act. The Commission has the power to direct concerned Authority/office to compensate the complainant. It is not necessary that the issue of compensation can arise only out of complaints. It can crop up out of second stage appellate proceedings as well. The Commission on its own can also initiate the grant of compensation. A direct link (nexus) between the loss and the action of the Authority/office or the Public Information Officer must exist for a compensation claim to arise. The complainant will have to establish (substantiate) that the loss was due to the action of the  Authority/office or the Public Information officer.
