TAKING MATTER TO COURTS

There is limited scope of interference by the Courts on any matter arising out of any proceeding under the Right to Information Act. There is a specific Bar of jurisdiction of Lower Courts. That means the Courts donot have any power to look into matters arising out of proceeding under this Act. The Act further specifies that the decision of the Commission shall be binding. A citizen of India has therefore to follow the appeal mechanism prescribed in the Act. However, this does not mean that the decision of the Commission are final and cannot be challenged further.

The Fundamental Right of every citizen enshrined in the Constitution of India are sacrosanct and cannot be curtailed by any Law including the Right to Information Act. And, if these rights are violated, writ jurisdiction of High Courts and Supreme Court shall always be allowed.
